<text>
Eneida

Eneida
¿El patrón se enojó?

Lalo

Eneida
¿No fuiste a trabajar?

Lalo
Y no me hablaba.

</text>

              <text>
Eneida
Today is Thursday, May 5 and I am meeting with Lalo, a name we will use to protect the identity of our interviewee. He is an agricultural worker who suffered a workplace accident at a dairy in northern Colorado and he is going to tell us about his experience in this situation so that other workers know what steps to take in the event of an accident of this type. Lalo, tell us how old are you and where are you from?

Lalo
I am originally from Tehuacan, Puebla, Mexico. I am 26 years old and a little while ago, about three months ago, I had an accident. One morning I went to work at 6:00 a.m. and unfortunately, about an hour later, since we do different jobs every day, that day we had to take cows out of the pens to select the ones ready to calve. And one cow that wouldn't let us take her out of the corral, well, we wanted to stop her among three people and the cow came and threw two of the three of us who were there. But the other fellow didn't, nothing happened to him. It threw me, it passed over me, but I don't know if it stepped on my hand or how it happened, or if it was a fake when I fell. And when I got up, I felt the pain in my hand, in my right wrist. I wanted to use strength, well, in that hand, at that moment, but even when I wanted to use my hand I felt great pain and at that moment I could no longer work. And the boss was there, he said to me: "Oh well, how do you feel?" I told him no, I felt a strong pain. "If you can work, keep working and if not [he said] I'll make an appointment with the doctor right now so you can go and get checked".

Eneida
And then, if you were checked at the doctor?

Lalo
Yes, they did check me, but it was about two hours later.

Eneida
After you had the accident?

Lalo
Yes.

Eneida
When you went to the appointment, what did the doctor tell you?

Lalo
I went to the doctor and he told me that he took some x-rays where two bones had broken in my right hand. And from there he made another appointment, but it was five days later with a doctor.

Eneida
And did you go to work during those five days before the second appointment or did you stay at home?

Lalo
No, because the doctor told me I could not work.

Eneida
And did you notify your employer that you could not work those five days?

Lalo
At that time I advised him and the doctor also told him that I could not work.

Eneida
What did he say about it?

Lalo
No, at that moment, yes, if I was well, the first thing was to recover and that was it.

Eneida
And after that what happened when you went on the second date?

Lalo
At the second appointment with the doctor, he was a surgeon. And there he told me that yes, I did need surgery.

Eneida
And you underwent surgery after how many days?

Lalo
Two days after, since I suffered the accident it was, well, almost seven days after.

Eneida
Did you have surgery?

Lalo
Yes.

Eneida
Did your employer explain to you that they were going to pay for your medical expenses or did they give you training before, when you came to work, to tell you what happens when there is an accident on the job?

Lalo
No, but when I came in I had no training. Nothing. Well, at that moment I didn't know what to do, well, I didn't know what to do. I didn't know if the insurance was going to cover it then, but the doctor told me that when... the day I fell, he told me, the insurance has to cover it. Since you fell, you were injured at work or if you don't have insurance, your employer has to cover it. So, they operated on me, but they told me I couldn't work for 15 days. The doctor dialed the employer again and told me this, yes, it's fine, if you rested for 15 days. But after 15 days had passed, when they removed the stitches from the operation, I went and he said, "No, you can work now. The stitches have been removed. But since the wound was fresh, well, at that time, at that moment, snow was falling, it was very cold, my hand was freezing, so I asked the employer for another eight or fifteen days.

Eneida
And he didn't want to give them to you?

Lalo
No, he would not give them to me.

Eneida
And then he paid you for those, those 15 days?

Lalo
The....

Eneida
What did you have after the operation?

Lalo
After the operation he did pay me. But, it was 15 days after the stitches were removed and he wanted me to go back to work.

Eneida
With pain?

Lalo
With pain.

Eneida
And weren't you told that you had the right to see the doctor again so that the doctor could check you and give you more days off?

Lalo
He didn't want to but I talked to the doctor and the doctor told me "if you feel pain you can't go to work" and then he got angry and went to .....

Eneida
Did the employer get angry?

Lalo
Yes, he got angry. "No, you have to come to work and if you don't, then you have to cover your expenses. I told him no, if he was going to run me off, then let him run me off. "And you have two more days. But as it was snowing and it was very cold....

Eneida
Didn't you go to work?

Lalo
No, I didn't go to work for about a week. And he wouldn't talk to me. A week later the foreman started to call me asking me how I was doing, but the boss was there. And then he passed it on to me, asking me how I was. But at that moment he was no longer angry. He asked me how I was doing and if I could go back to work at that time, that I should go.

Eneida
And what did you tell him?

Lalo
Among us roommates, those of us who shared the house here, one of them had the lawyer's number and we dialed her and she saw us because.....

Eneida
Okay, and I'm also seeing over here that, in addition to the support that Colorado Legal Services provided you, you also got the support and assistance of our partner and advocate, Ana Su, who helped you navigate this whole workers' compensation system when you suffer a workplace injury, which is available regardless of immigration status and for which you apply because you had this workplace accident.

Lalo
He just asked me about the accident and how it all went and what I was going through at work, and I explained everything to him, I gave him the hospital papers and then when the employer called me back to tell me to go back to work, he said "so are you going to come back to work or not? And I said, well, if you give me a job, but only until I recover, but not right now, and if not, I am going to get a lawyer...

Eneida
Did you mention the lawyer's name?

Lalo
Yes, yes, yes....

Eneida
And what was your boss's reaction?

Lalo
And then he told me how many days I needed to return to work. And he left me another 15 more days, in total it was, from the accident until I returned to work, it was a month and a half.

Eneida
A month and a half... And after Doña Ana, the promoter, intervened and started to mobilize, both of them, taking different steps with the lawyers, did the employer change his way of thinking about what, that you had to go to work?

Lalo
Yes, it was totally different.

Eneida
And do you think what would have happened if you had not had access to help like Promotora Network to solve your case, what do you think would have happened?

Lalo
I believe that if the employer had left me without a job, or as I had mentioned before, that I would have to pay my own expenses.

Eneida
Of the medical expenses he had said?

Lalo
Yes.

Eneida
Okay and after Doña Ana went through all the processes, how did you feel about having someone who was there for you and knew about your rights?

Lalo
No, I felt supported because I don't know anything about rights. They didn't give us any training there, and with the help of Doña Ana, since she intervened, we mentioned it to the employer and I felt a little more confident.

Eneida
Are you still working there today?

Lalo
Yes, I went back, since the accident a month and a half later I returned to work there. He put restrictions on me that I could not lift heavy things, or where a lot of force was used that I could not do it.

Eneida
And that's, let's say, the right thing to do. Okay. How do you feel about your health right now? Do you feel like that accident has left you different when it comes to lifting and you're always going to need to have lighter work?

Lalo
That is normal, since we handle machinery and everything, is that when I handle machinery, it is normal, I don't use much force. But when there is work that requires lifting something or using force, then I still feel a lot of pain. Not much anymore, but yes.

Eneida
And, what have you learned about this accident process, from what you didn't know to what you now know?

Lalo
No, before I didn't know anything, I didn't know what to do, and now, for example, I know, if something happens to a colleague, or things like that, the first thing I would do... look for a lawyer, look for help.

Eneida
Very good. And, anything else you want to say about this case?

Lalo
No, we should always be careful at work. Well, we always want to look good with the boss, but (unintelligible)... not him. When things like that happen to us, an accident or something, they treat you differently.

Eneida
What would be your message to farm workers who do not yet know their rights and/or who may be exposed to an accident at work? What would be your message to them?

Lalo
Always be careful at work and if there is an accident or something, then seek help. If we don't know how to do it, then with the help of someone else it is different.

Eneida
Thank you very much for telling us your story. Surely many other farm workers in different regions of Colorado are going through this same situation or have gone through it. And to hear your testimony and to know that there is a program or there are associations that can help farm workers is important. And also the issue of educating each other about the fact that as farm workers there are laws that support us and that cover us and that is very important. And now you and your colleagues can pass the word on to others so that the rights of farmworkers continue to be respected.
</text>

              <text>Estamos en pleno verano en el norte de Colorado, ya es julio del año 2022 y el trabajo en el campo está en su punto más alto, simismo la temperatura que ronda entre los 90 o más de 100 grados. Y hoy estoy con una trabajadora agrícola de un cultivo de verduras de la ciudad de Greeley Colorado, a quién llamaremos Lila para resguardar su identidad. Y ella nos va a contar acerca de los retos que enfrentan los trabajadores agrícolas bajo estas inclemencias de la temperatura. Lila, cuéntenos, ¿Cuántos años tiene trabajando en la agricultura y cuáles son los retos que enfrenta cada día para hacer su trabajo?

No sé si gustas ver ahí atrás.

              <text>Promotora: It's midsummer in Northern Colorado, July 2022, and work in the field is at its peak. And work in the fields is at its peak, as is the temperature, which is in the 90s or over 100 degrees. And today I'm with a farm worker from a vegetable farm in the city of Greeley Colorado, who we'll call Lila to protect her identity. And she is going to tell us about the challenges farm workers face under these inclement temperatures. Lila, tell us, how many years have you been working in agriculture and what are the challenges you face every day to do your job?

Lila: I have been working here in agriculture for seven years. As you can see, the sun is strong. Our duty is to clean. I don't know, behind your back, we have the field. Our duty is to clean everything, everything that is bad in the onion. So we have to go around, how do you say, like about... like it's about 7 feet. I don't know if you like see back there. We have to finish everything, what is that field, that line, that is our goal, that we have to finish it in 2 or 3 hours, because we have to go through everything, the whole field, that comes from there to there. We are several people. It is very heavy, it is very heavy because of the sun. Sometimes when it rains, it makes a lot of puddles and mud, we also struggle a lot with that, don't believe it. But we are here working hard.

Promotora: Definitely Lila, the farmer's work is a very hard and heavy job. And we would also like to know how you protect yourself, or self-protect yourself, from these high temperatures?

Lila: Look, we carry our water bottles, we wear our hats and our t-shirts, you gave them to us. And we drink water, when suddenly here we have our bathrooms, which are also very far away? I don't know if, because of the distance, here are the bathrooms, sometimes they are not, no, they are not very clean and we struggle with that too. (inaudible)... they give us our (inaudible) water, but we carry our little bottle of water to, to last the whole walk to get here.

Promotora: And how many hours do you work a day?

Lila: We work from six in the morning to five in the afternoon.

Promotora: And do you have a break? How often?

Lila: We have a break, from 6 ah... to... we start at 6 o'clock and our first break is at ten o'clock in the morning, the second one is at 12 o'clock and the third one is at 3:00.

Promotora: And do you think that's enough time to rest when the temperature is over 100 degrees?

Lila: No, I don't think so, it is not enough because if I... I mean, right, it would be a break every two hours, or every three hours in in a full shift.

Promotora: Okay, aren't they getting breaks every two hours when the temperature is above 100?

Lila: No. Mine are the same breaks no matter what the weather is like.

Promotora: And, what are, let's say, some recommendations that you can give to the farm workers with your experience already of 7 years of working in agriculture under the sun?

Lila: Well, since here they let us carry our water bottle, we have to bring our sunscreen, I highly recommend sunscreen because sometimes we get very burned; our repellents, for the mosquitoes in the mornings, because mosquitoes also bite us.

Promotora: There are so many challenges. Lila, and listening to all this I am curious to know, what motivates you to continue working every day in agriculture?

Lila: Well our family inspires us, to look for work, and to work hard because we are here to put in the efforts and put in the sweat.

Promotora: As we can hear, farmworkers face many challenges and hearing Lila's testimony, we realize that the law regarding high temperatures, where employers must provide a break every 2 hours when temperatures exceed 90 degrees, is still not being enforced. There is still a long way to go before these laws are enforced and protections become a reality for workers.</text>

              <text>

              <text>
Let's talk about health and housing for workers in dairies. To do this, we need to know who these people are, where they come from, what are the resources at their disposal, their limitations and needs.

In the outreach work I have conducted in the last 3 months of 2022 in the area of Kersey, I have found that around 99% of agricultural workers in diaries are immigrants originating from Mexico, Guatemala, El Salvador; however, we must now add the nicaraguan community which is growing at an accelerated pace in northern Colorado. They are covering a large part of these job openings in this area inside of the dairies and unlike other groups, they are a group that is barely starting to find its way.

These Nicaraguans are people who arrived with a friend, a distant relative and don't have stable housing. The majority left their wives and children in their home country and are without family. Many are living in trailer homes located inside the dairies, this is to say that they work and live in the same place. They don’t have transportation and lack emotional stability.

Speaking with some of them who have solicited help to access health services, they have shared how living and working in the same place impacts their physical and mental health. Doroteo * is one of those workers whom I had the opportunity to provide outreach for. He, at 38 years old, is seeing his health being affected by depression, anxiety and a strong allergy due to the excess of dust where he lives, which is the dairy.

Basically, they spend their time there 24/7. They don’t have transportation and only leave every 15 days to the supermarket to buy food by catching a ride that takes them specifically to that place for a cost of $40. He also shared with me how desperate he finds himself because of this situation and that he wants to change jobs because this has also brought him problems with insomnia. It is notable in his face, he has dark circles under his eyes, he is thin and although he has a great sense of humor when he talks to me, his sadness is evident.

I visited him in his place of living to take him to the clinic and I could verify the living conditions. The houses are equipped but their location is inside the dairy and it turns out to be very depressing. They stay home locked up because going outside means exposing themselves to the sun and to the strong contamination from the dust. There is not a nearby park for them to go for a walk, there are no public transportation services and paying for a ride is literally a luxury for people who have several thousands of dollars of debt back in their home country.

At the end of this story Doroteo* let me know that he was able to get help from a friend in Denver to move to the capitol and left the dairy. He considers that at the least there he can count on public transportation and can go places without needing to depend on a ride and he hopes this decision brings about a significant change in his physical and mental health, even though he does not rule out the possibility of returning if things don’t go well in Denver.

Also, it is important to highlight that Nicaraguans are a very vulnerable population because they are barely opening up a path for themselves in a way that is different for other communities from Mexico, Guatemala and El Salvador, who have decades of migration and millions of inhabitants in the community.

              <text>Hello good afternoon, I am an Immigrant from Mexico I have lived in this country about 6 years but in this state I have 5 years of having arrived. Since I arrived in the United States of America I have worked in the countryside, thanks to this we have been able to get ahead my wife and I, and my family living in Mexico because from time to time we help them with something because the situation there is a little difficult.

I have always worked with the same patterns, I like my work and what there is to do but that does not mean that it is not heavy work, it is well known by all that fieldwork is the hardest thing because we suffer the different climates and although it rains or snows the work does not wait.

In this pandemic, I have been very concerned, because although where we work we were told how to take care of ourselves we are many people who work on the ranch and it is difficult for all of us to take care of ourselves the same because not all of us are aware of what we are going through, and we cannot stop working because we cannot ask for unemployment like the people who do have their citizenship so all we have left is to pray that we return home safely, because as I say we cannot afford to stay in. If I’m in a country that’s not mine, it’s just for a chance of a better life just that, I’m not here to ask anyone for anything, all I want is to work and be able to live in peace.

I don’t ask for anything out of this world but unfortunately here, we’re not treated like people. In many places they only see us as an object to do something because as they know that we have need they say that we have to put up with it.... In my work I have asked several times for a pay increase because I am paid the minimum salary and my employer says you can stay more overtime for you to make more money but does not pay me overtime, the amount of hours I do are paid at a fixed amount, this is where I say that if I was a citizen they would not do that because they would pay them as the law says.

That’s why if I had a minute to talk to state legislators I’d tell them,
“PLEASE BE OUR VOICES BEFORE CONGRESS ASK FOR MORE HUMANE AND FAIR TREATMENT FOR US WE ARE GOOD PEOPLE WHO ONLY WANT A BETTER FUTURE AND A BETTER LIFE, WE TOO HAVE THE RIGHT TO HAVE ALL THE OPPORTUNITIES THAT PEOPLE WHO DO HAVE PAPERS, BECAUSE WE ARE THE SUPPORT OF THE FOOD SYSTEM.”

Finally I want to remain anonymous, but if I wanted to share my feelings about this situation that millions of people go through every day.</text>

Porque ahí nadie le daría nada.

00:59.000 --> 01:23.000

01:25.000 --> 01:40.000
She asked the employer if someone was going to help her, and she said no. That no one would do that job with her and that she should prepare well with clothes and shoes suitable for the weather. Because there, nobody would give her anything.

00:59.000 --> 01:23.000
[Promotora] She says the employer was very clear in telling her that she would be paid at $12 an hour and that she had to work whenever there was work, regardless of holidays or weekends. That she couldn't miss work unless it was a major emergency and still had to give her plenty of notice.
[Promotora] As if emergencies give us time to anticipate - she mentions with a sad smile.

01:25.000 --> 01:40.000
[Promotora] This happened last year, and, in the winter, she is out of work. <text>00:00.000 --> 00:18.000

00:19.000 --> 00:50.000

00:52.000 --> 01:31.000

01:32.200 --> 02:00.000

02:01.000 --> 02:25.000

02:25.500 --> 02:55.000

Muchas gracias</text>

              <text>00:00.000 --> 00:18.000
[Promotora] Good afternoon, my name is Claudia Chávez, I am a promoter of the Northern Area 1.
[Promotora] This story is from a farmer who has been working on this ranch called ***** for 10 years and is located on the shores of Brighton Colorado.

00:19.000 --> 00:50.000
[Promotora] The farmer shared with me that what they do during the summer is that they plant various varieties of vegetables and work long hours 7 days a week.
[Promotora] Their salary is $12 an hour and they are not paid overtime. During the summer you need to save money to survive the winter, which is when work is divested.

00:52.000 --> 01:31.000
[Promotora] In the winter they work inside the winery selecting, cleaning, and packing the vegetables. And they send them to stores and restaurants.
[Promotora] This time of pandemic has further lowered working hours. Because the product they sell is very little, for example: before the pandemic, they would send a small truck - now there are 3 sackcloths or sacks that are sent.

01:32.200 --> 02:00.000
[Promotora] So this has affected their salary and in recent months they have earned $900 in a month. And it is with which you need to cover your income, food and other needs.
[Promotora] Apart from needing a fair salary, other needs are medical service.

02:01.000 --> 02:25.000
[Promotora] He shared with me that he has been hurting his shoulder from working so many hours with the hoe and still he continues to work with the pain.
[Promotora] Something that I observed when listening to him, was when I saw his dry and cracked hands.

02:25.500 --> 02:55.000
[Promotora] His tired face, his gaze lowered. For a moment, he was quiet and thoughtful.
[Promotora] But when he finished, he said that he has to continue fighting day by day for the sustenance of his family.
[Promotora] This farmer decided to remain anonymous. Thank you!</text>

              <text>
Greeley, CO July 5th, 2021

              <text>
Greeley, CO July 5th, 2021

Interview with Mr. M, Maintenance Manager of a Dairy in Weld County.

Mr. M was born in Tijuana, Baja California, México. He studied in elementary school. Since he was a child he studied and worked to help his family: his parents and nine siblings. In Tijuana he took a course on electricity, he worked in a factory and did maintenance jobs in different areas. He formed his own family and has a 19 yr old son who completed High School.

He crossed through the hills into California, it was difficult. Afterwards, his uncles helped him come to Colorado and he obtained work at the dairy in Weld, but he lives in Greeley. He started doing everything: cleaning, changing hoses, plumbing, etc. He never said no and the General Manager “Chico” as everyone calls him, helped him. He hasn’t worked directly with the cows in the field. “Chico” gave him the opportunity to do maintenance jobs in the factory since he knew about maintenance and electrical work. He did that for 3 or 4 months and then they “released” him into the responsibility of making decisions. Maintenance costs were reduced by taking care of pumps, caring for the protection against bacterias with cleanliness and hygiene.

"I had a family to support, a lot of work for little pay. I decided to come to the United States when I was about 40 years old."

"I always had my goals clear. I wanted to excel, not conform, be a good co-worker, be a good example of a worker and a person. Together with “Chico and Don Roque” we have formed a good team. I have been offered work at other companies and not accepted because I believe that if the company has treated me good, has given me the opportunity to progress, I should be loyal to the company. They appreciate the work of us Mexicans. If we work well, with responsibility and loyalty, you receive a lot. For example, they pay my rent and I have my salary. I’ve worked at the dairy in Weld for the last 14 years.

Personally it has been difficult to distance myself from my family. They are in California. I am looking forward to seeing them. It is hard being separated from them. I am eager to continue studying. I would like to learn more, be well trained. Continue the goals that I’ve alway had: get ahead, stand out and continue to be a good worker and partner."
</text>
