According to sources close to the family, Mr. Panzo Temoxtle was operating the manure vacuum truck when it appeared to have lurched forward and fell into the manure pit, submerging the cab of the truck in the fetid liquid manure with Panzo trapped inside. Despite their efforts, the other workers on site were unable to pull the heavy vacuum truck out of the pit with a forklift in order to free Panzo. It wasn’t until a helicopter arrived on the scene that they were able to access Panzo, who had been submerged for approximately 30 minutes by the time they were able to retrieve him. Panzo was immediately taken to North Colorado Medical Center but eventually died from hypoxic injuries sustained in the accident. Juan Panzo Temoxtle was declared dead the morning of Wednesday, March 31, 2021. He leaves behind a wife and three children in Mexico.

Sources say that Panzo Temoxtle had only been working at Shelton Dairy for about 6 weeks and that March 30th was his first day operating the dairy’s manure vacuum truck. A co-worker, who was just outside of the cab and reportedly training Panzo on the machinery, was able to make it out of the manure pit shortly after the truck submerged and did not appear to suffer any life threatening injuries. Photos from the site of the accident appear to show that there was not a guarding mechanism sufficient to prevent power driven machinery from breaching the manure storage area.

Juan Panzo Temoxtle is an immigrant from Mexico, as are most of the workers at Shelton and in the greater Greeley-area dairy sector. Immigrant workers, including those who come to the U.S. with H2A visas, make up over 67% of agricultural workers in Colorado. Their treatment, according to Nicole Civita, a food, agricultural and labor lawyer and Project Protect Food Systems Workers’ Policy Director, is a racial justice issue. “Agricultural workers have been historically excluded from worker’s rights legislation both nationally and in Colorado because the work is and has been done by black and brown workers. Undocumented workers are especially vulnerable to exploitation and at risk for harms from unjust or unsafe working conditions because their legal status makes their presence and ability to earn a living in the United States very precarious. Many employers take unfair advantage of this dramatic power difference,” Civita said.

Shelton Dairy, with at least 2800-head of dairy cattle, is apparently run by Ron Shelton, who is also on the Board of Directors of The Dairy Farmers of America. Ron Shelton served as treasurer for the Mountain Area Dairy Council for 14 years. He also has served on the National Dairy Promotion and Research Board and is a member of the Dairy MAX (formerly Western Dairy Association) promotion board. From 1995 through 2020, Shelton’s affiliated business, Shelton Land & Cattle Ltd, received federal subsidy payments totaling $2,103,587.

The morning after the incident, Panzo’s co-workers who witnessed the tragic accident were made to resume work; they were not provided any trauma counseling or other supportive services. As of this date, Shelton Diary has not reached out to the family and friends of Panzo who live in the area or offered them any support. Thanks to the local promotoras and neighborhood outreach workers of the Project Protect Promotora Network (PPPN), Panzo’s family was able to receive support and assistance in navigating this horrific situation.

According to the Washington Post, “Agricultural workers suffer fatal on-the-job injuries at a very high rate — far higher than police officers and more than twice the rate of construction workers in 2015, the last year for which comprehensive records are available.”

Historically, there is not much federal oversight of this industry, even when it comes to farm worker health and safety issues. All employers, however, are required to notify the Occupational Safety and Health Administration (OSHA) when an employee is killed on the job and the notification must occur within 8 hours of the fatality. Although OSHA does not investigate on-the-job fatalities that occur on farms with 10 or fewer nonfamily employees, OSHA is required to complete an investigation in this case since the dairy has well over 10 employees. Sources close to Panzo’s family say that the family is not aware to what extent, if any, an OSHA investigation has commenced regarding the tragic accident that took Panzo’s life.

At this moment, there is a bill working its way through the Colorado Senate, SB 21-087 “Concerning Agricultural Workers Rights.” This bill would positively impact the working lives of agricultural workers, including their ability to report hazardous situations like the one at Shelton Dairy, where there appears to have been insufficient safety measures and a lack of adequate training. The bill is being criticized by Republican lawmakers, who say that the government intervention is not necessary.

The CDC and the NIOSH urge extreme caution around manure pits and warn against workers entering manure pits because the noxious hydrogen sulfide fumes at the surface may be immediately dangerous to life and health. Hydrogen sulfide is a chemical asphyxiant with effects on both oxygen utilization and the central nervous system. Workers exposed to high concentrations of hydrogen sulfide in manure collection facilities can experience shock, become unable to breath, and lose consciousness within just a few breaths. Because they quickly become unable to save themselves, it is possible to drown in just inches of cow waste.

A promotora with the Project Protect Promotora Network who has been supporting Panzo’s community in Greeley said, “This is another tragic loss of life that could have been prevented. We do not do this work to see farm workers die, and this has been devastating to us as advocates and as a community. We need to guarantee protections for workers. Every human life matters.”

State Representative Yadira Caraveo, a sponsor of SB21-087 and ardent advocate for the rights of both workers and immigrants, shared her condolences and her determination to protect the people who labor at the foundation of Colorado’s agricultural economy: “My prayers are with Mr. Panzo Temoxtle’s family here and in Mexico after their tragic loss. Workers like Juan come here to provide a better future for their families and they provide essential services that keep Coloradans fed and keep our farms and ranches running. We cannot continue to have environments that cost these workers their health and even their lives as they go about their jobs. I will continue to work to ensure that we provide basic protections for farmworkers so that accidents like these do not cost any more lives.”

Panzo’s wife, Serafina Caliuhua Gonzalez, mourns her family’s loss, saying, “Juan came to the United States to have a better future for his kids, but unfortunately God had another plan for him. Juan wanted his kids to have a career and have a better future. He worked so hard for us. We depended on Juan, and now we have no one to depend on, no one to support us.” Front Line Farming, a BIPOC/womxn-led food and farmers advocacy group focusing on food growing, education, sovereignty and justice, has set up a GoFundMe fundraiser to provide financial support to Juan Panzo Temoxtle’s family.
